Does it take much explanation to show that building houses on old dumpsand toxic waste sites is a bad idea? Such construction is vulnerable toland settlement and migration of subsurface toxic gases into buildingsthat can poison occupants. Besides, such development undermines theproper cleanup of toxic sites and closure of landfills by forcingadditional toxic leachate to migrate further and faster intogroundwater, thus polluting drinking water and nearby river ecosystems.It also impedes the recovery of methane, a powerful greenhouse gas, andother noxious gases generated by decomposing garbage. So instead of prohibiting construction of homes on landfills and toxicsites to protect the environment and public health, as required by law,DEP encourages such practices as a means of generating "projectfinancing" for clean-up. It compromises both environmental and taxpayerinterests. *Incomplete cleanups. Unfortunately, building homes over landfillsand toxic sites is common in the Garden State. Our laws mandate"capping"contaminated soils on-site and allowing residentialconstruction at capped sites unless the DEP can prove that a cap isunsafe. Caps can beas little as a few inches of dirt to cover toxicpollution. As a result, more than 90 percent of New Jersey "cleanups" are infact coverups. This leaves our toxic legacy buried in the ground andleaves future generations facing health and environmental risks. . * Playing with dirty dirt. Contractors imported thousands of cubic yards of toxic sludge,contaminated soil and highly questionable "recyclable materials" thatwere used as clean fill or landfill-capping material. This made existingtoxic problems at the site far worse. Press reports disclosed that DEPlacked even a basic ability to monitor contaminated materials importedto the site. A similar lack of DEP oversight at the cleanup of the Ford plantin Edison resulted in PCB-contaminated soils and demolition debrisbeing used as clean fill at 19 housing projects in central New Jersey. These same practices not only continue across our state; they are encouraged and subsidized by DEP. We are spending millions of dollars to clean up toxic soils, only toallow scam operators to "launder" and dump them in someone else'sbackyard.This is insane.
